  • 1. The accused bought or sold or received or aided in selling property that had been stolen or obtained by extortion
  • 2. When the accused acted, he or she knew that the property had been stolen or obtained by extortion.
  • 3. The property in question was a motor vehicle, trailer, construction equipment or naval vessel.

 

For violating Penal Code 496d(a) those charged with misdemeanor Receiving Stolen Goods violations face:

 

  • Imprisonment in county jail for up to one year, and/or
  • Fine of up to $1000

 

Those charged with a felony violation of Penal Code 496d(a) eceiving Stolen Goods face:

 

  • Imprisonment in state prison for 16 months, 2 years or 3 years, and/or
  • Fine of up to $10,000
