An adult who resides with a minor under 18 that commits more than three lewd acts or “substantial” sexual contact with a minor and did so within the space of three months is prosecuted as violating CPC 288.5. The sexual contact could be oral sex, masturbation, or sexual intercourse with the child. Sexual acts with a child under 10 is covered by PC 288.7, which has different penalties.
